1. Acceptance

By using our website design, development, hosting, and digital consultancy services (“Services”), you agree to these Terms and Conditions (“Terms”). These Terms are governed and construed in accordance with the Indian Copyright Act.

2. Description of Services

    • Website Uptime Monitoring
    • Problem Troubleshooting and Bug Fixing
    • Security Updates and Patch Management
  • Digital Consultancy:

3. Client Responsibilities
3.1 Providing Content
  • The client must provide all necessary content (such as text, images, videos, etc.) for use on the website.
  • Content can be provided via email, WhatsApp, chat, or other communication channels.
  • Providing content on time ensures that the project timeline remains unaffected.
3.2 Ensuring Copyright Compliance
  • The client must ensure that the provided content does not infringe upon any copyright or intellectual property rights.
  • Any legal liabilities and consequences arising from copyright infringement will be the sole responsibility of the client.
  • We only provide the service of uploading content and are not responsible for the legality or validity of the content.
4. Payment Terms
4.1 Payment Structure
  • A 50% advance payment of the total project fee is required at the start.
  • The remaining 50% must be paid just before the website launch.
4.2 Timely Payment
  • All payments must be made on time to ensure the project timeline is met.
  • Delayed payments may affect the project timeline and may incur additional charges.
4.3 Other Terms
  • Work on the project will commence only after the initial payment is received.
  • The website will be launched only after the final payment is received.
5. Renewal Terms
5.1 Timely Renewal
  • Clients must make payments for website hosting and domain renewal at least 10 days before the renewal date.
5.2 Late Fees
  • First 15 Days: A late fee of ₹500 will be charged if payment is made within 15 days after the renewal date.
  • Next 15 Days: An additional late fee of ₹1000 will be applied if payment is not made within the next 15 days.
5.3 Redemption and Domain Loss
  • If payment is not made within 30 days of the renewal date, redemption fees and an additional ₹1000 late fee will apply.
  • The client will be fully responsible if the domain expires or becomes unavailable.
5.4 Regular Renewal
  • Clients must keep track of renewal dates.
  • We are not responsible for any technical or business issues arising from delayed renewals.
6. Quotation Validity
  • Any quotation issued by us, whether via email, WhatsApp, or any other medium, is valid for only 15 days.
  • After 15 days, the quotation becomes invalid, and a new quotation may be required.
  • Prices or service terms may change after 15 days, necessitating a new quotation.
7. CMS / Dynamic Website Security
7.1 Security of Login Details
  • The security and confidentiality of the website login details (username and password) provided to the client are the client’s responsibility.
7.2 Hacking and Security
  • Clients must store login information securely and protect it from unauthorized access or hacking.
  • We are not responsible for any hacking or issues arising from compromised passwords.
7.3 Password Security Suggestions
  • We will provide password security recommendations and advise regular password changes, but adherence is the client’s responsibility.
8. Hosting Terms
8.1 Hosting Details
  • We host websites on dedicated servers or VPS servers.
  • Each client’s website operates on separate cPanels to effectively manage website speed and performance.
8.2 Data Backup and Restoration
  • In case of accidental data loss, backups will be provided (30 days, 7 days prior, or 1 day prior as mentioned in the quotation).
  • Additional fees may apply for restoring backups, which the client must bear.
8.3 Availability of Backups
  • Backups are available on our servers for a limited time and can be installed upon request with applicable fees.
9. Domain Ownership and Renewal Terms
9.1 Domain Ownership
  • Domains booked by us will be the property of the client.
9.2 Domain Renewal
  • If a domain expires, the client must renew it through us to regain access.
9.3 Transfer and Access
  • Clients can request domain transfer or access before expiration.
  • After expiration, renewal and associated fees become the client’s responsibility.
9.4 Consequences of Late Renewal
  • Clients are responsible for any issues arising from delayed domain renewals.
10. Design Approval and Revision Terms
10.1 Initial Design
  • We will present the initial design to the client.
  • Revisions will be made upon client’s request.
10.2 Scope of Revisions
  • Design changes will be limited to the number of revisions specified in the quotation.
  • Additional revisions beyond the specified number will incur extra charges.
10.3 Additional Revisions
  • Charges for additional revisions will be based on the nature and complexity of the changes.
10.4 Client’s Advice
  • Clients should clearly communicate all requirements during the initial design phase to ensure a smooth process.
11. Fonts and Graphics
11.1 Free Fonts
  • We will use Google’s free fonts and other free fonts in website design.
11.2 Paid Fonts
  • If the client requires specific paid fonts, the client must bear the cost.
  • Licensing fees and associated costs for paid fonts are the client’s responsibility.
11.3 Client’s Advice
  • Clients should specify font requirements at the outset to facilitate appropriate font selection.
12. Copyright and Content Responsibility
12.1 Client’s Responsibility
  • The client is fully responsible for all content displayed on the website (text, images, videos, etc.).
  • We do not verify the copyright status of the content.
12.2 Ensuring Legal Rights
  • Clients must ensure they have the legal rights to use all content on the website.
12.3 Action on Claims
  • If a third party claims unauthorized use of their content, we reserve the right to shut down or remove the client’s website without prior notice.
  • The client is responsible for any damages arising from such actions.
12.4 Client’s Advice
  • Ensure that all content used on the website complies with copyright laws.
13. Prohibition of Offensive and Illegal Content
13.1 Restricted Content
  • Our hosting and website services do not permit offensive, illegal, obscene, or any other inappropriate content that may offend individuals, communities, or society.
13.2 Right to Take Immediate Action
  • If such content is detected on the website, we reserve the right to shut down or terminate the website without prior notice.
13.3 Liability
  • The client is fully responsible for any damages arising from the presence of prohibited content.
13.4 Client’s Advice
  • Ensure that all content on the website is legally and culturally appropriate.
14. Advertising Services and Liability for Results
14.1 Advertising Fees
  • Clients are responsible for the budget spent on advertising platforms (e.g., Google Ads, Facebook Ads).
  • We provide only advertising setup, management, and operation services.
14.2 No Guarantee of Leads or Results
  • We do not guarantee the quantity or quality of leads generated from advertising campaigns.
  • We are not responsible if the desired results are not achieved.
14.3 Nature of Services
  • Our role is solely to manage advertising campaigns, not to guarantee a specific number of leads.
  • External factors beyond our control can affect campaign performance and results.
14.4 Liability
  • The client bears full responsibility for the outcomes of advertising campaigns.
15. SEO Services and Ranking Guarantee
15.1 Description of SEO Services
  • We will work on the keywords specified in the client’s chosen quotation.
15.2 Ranking Expectations
  • We aim to achieve top rankings for 50% to 80% of the specified keywords.
  • Ranking fluctuations of up to 20% are possible and cannot be controlled by us.
15.3 Changes in Rankings
  • Search engine algorithm changes, competition, and other external factors can affect keyword rankings.
15.4 No Guarantee of Rankings
  • While we follow all appropriate SEO strategies, we are not responsible for fluctuations in keyword rankings.
15.5 Payment According to Package
  • Clients must pay for SEO services as per the package outlined in the quotation.
  • Services and results provided will align with the specified package.
15.6 Client’s Advice
  • Clients should be prepared for potential changes in SEO rankings, even if targets are nearly met.
16. Limitation of Liability
  • Intechniq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, whether arising from breach of contract or otherwise.
  • Our total liability, whether direct or indirect, under any circumstances shall be limited.
17. Indemnification
  • The client agrees to indemnify and hold Intechniq, its directors, employees, and agents harmless from any claims, losses, liabilities, damages, expenses (including legal fees) arising from the client’s content, use of services, or breach of these Terms.
18. Governing Law and Jurisdiction
  • These Terms are governed by and construed in accordance with the laws of India.
  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi.
19. Termination
  • Intechniq reserves the right to terminate the services of any client who violates these Terms without prior notice.
  • Upon termination, the client must settle any outstanding fees.
20. Severability
  • If any provision of these Terms is found to be illegal, invalid, or unenforceable, that provision shall be severed from the Terms, and the remaining provisions shall continue in full force and effect.
21. Entire Agreement
  • These Terms and Conditions constitute the entire agreement between Intechniq and the client, superseding any prior agreements or understandings, whether written or oral.
